ข้อกำหนดการใช้งาน
1. คำนำและการยอมรับข้อกำหนด
ข้อตกลงการใช้งานฉบับนี้ ("ข้อตกลง") เป็นเอกสารกำกับความสัมพันธ์ระหว่างผู้ใช้ ("ผู้ใช้" หรือ "ท่าน") กับบริษัท/ผู้ให้บริการ ("บริษัท" หรือ "เรา") ซึ่งเป็นผู้ให้บริการแพลตฟอร์มโซเชียล–จับคู่ผู้คน ฟีเจอร์โพสต์–สตอรี่–กล่องข้อความ ฟีเจอร์ดูดวงไพ่ยิปซี และบริการอื่นที่เกี่ยวข้อง ("บริการ")
การที่ผู้ใช้เข้าถึง ติดตั้ง เปิดใช้งาน หรือใช้งานบริการของเราไม่ว่าทางเว็บไซต์ แอปมือถือ หรือช่องทางอื่น ถือว่าผู้ใช้ได้อ่าน เข้าใจ และยอมรับข้อกำหนดนี้ทั้งหมด รวมถึงนโยบายที่เกี่ยวข้อง เช่น Privacy Policy, Community Guidelines และนโยบายอื่น ๆ หากผู้ใช้ไม่เห็นด้วยกับข้อกำหนดนี้ทั้งหมดหรือบางส่วน ขอให้หยุดใช้งานบริการทันที
2. บัญชีผู้ใช้ / อายุขั้นต่ำ
ผู้ใช้ต้องมีอายุไม่ต่ำกว่า 18 ปี จึงจะสามารถสมัครบัญชีและใช้บริการของบริษัทได้ หากปรากฏว่าผู้ใช้มีอายุต่ำกว่าเกณฑ์ดังกล่าว บริษัทมีสิทธิระงับหรือยกเลิกบัญชีของผู้ใช้นั้นได้ทันทีโดยไม่ต้องแจ้งให้ทราบล่วงหน้า ผู้ใช้ต้องให้ข้อมูลส่วนบุคคลที่ถูกต้อง ครบถ้วน และเป็นปัจจุบัน เช่น ชื่อ อายุ อีเมล หมายเลขโทรศัพท์ และข้อมูลอื่นใดตามที่ระบบร้องขอ และต้องรับผิดชอบในการอัปเดตข้อมูลเหล่านี้ให้ถูกต้องเสมอ ผู้ใช้ต้องรับผิดชอบต่อบัญชีของตน รวมถึงการรักษารหัสผ่านและข้อมูลการเข้าถึงบัญชีให้เป็นความลับ และห้ามเปิดเผยหรือมอบบัญชีให้บุคคลอื่นใช้โดยไม่ได้รับอนุญาต บริษัทจะไม่รับผิดชอบต่อความเสียหายที่เกิดจากการใช้งานบัญชีโดยบุคคลที่ไม่ได้รับอนุญาต และผู้ใช้ต้องแจ้งบริษัททันทีหากสงสัยว่าบัญชีถูกเข้าถึงหรือละเมิด
3. รายละเอียดของบริการ
บริการของเราประกอบด้วยแต่ไม่จำกัดเพียง: การให้บริการแพลตฟอร์มออนไลน์ซึ่งช่วยอำนวยความสะดวกในการพบปะและสร้างความสัมพันธ์ระหว่างผู้ใช้ รวมถึงฟีเจอร์พิเศษ เช่น การดูดวงและคำแนะนำด้านความรัก ผู้ใช้สามารถสร้างบัญชีส่วนตัว กรอกข้อมูลเกี่ยวกับตนเอง และเข้าถึงฟีเจอร์ต่าง ๆ เพื่อค้นหาและสื่อสารกับผู้ใช้รายอื่น อาทิ ระบบโพสต์ สตอรี่ คอนเทนต์ต่าง ๆ บริษัทพยายามให้บริการด้วยความราบรื่น ปลอดภัย และเป็นส่วนตัว แต่ไม่สามารถรับประกันผลลัพธ์จากการใช้บริการได้ ผู้ใช้ยอมรับว่าการสร้างความสัมพันธ์หรือการรับคำแนะนำผ่านฟีเจอร์ดูดวงอาจแตกต่างกันไปในแต่ละบุคคล บริษัทมีหน้าที่เพียงจัดให้บริการตามที่ระบุไว้ในแพลตฟอร์มเท่านั้น
4. การชำระเงินและการคืนเงิน
ผู้ใช้ที่ต้องการเข้าถึงฟีเจอร์พิเศษหรือบริการแบบชำระเงินภายในแอปพลิเคชัน ต้องทำการชำระเงินตามช่องทางและวิธีการที่บริษัทกำหนด การชำระเงินทั้งหมดจะถือว่ามีผลสมบูรณ์เมื่อบริษัทได้รับการยืนยันการชำระเงินเรียบร้อยแล้ว ผู้ใช้ยอมรับว่าบริการชำระเงินบางประเภทอาจไม่สามารถขอคืนเงินได้ และบริษัทสงวนสิทธิในการพิจารณาอนุญาตการคืนเงินในกรณีที่มีข้อผิดพลาดของระบบหรือความบกพร่องจากบริษัทแต่เพียงผู้เดียว การชำระเงินและการใช้บริการใด ๆ จะอยู่ภายใต้ข้อกำหนดและเงื่อนไขของบริษัท และผู้ใช้ยอมรับว่าจะปฏิบัติตามอย่างเคร่งครัด
5. เนื้อหาที่ผู้ใช้สร้าง
ผู้ใช้มีสิทธิในการสร้างเนื้อหาและข้อมูลส่วนบุคคลภายในแอปพลิเคชัน เช่น รูปภาพ ข้อความ ข้อมูลโปรไฟล์ และข้อความแชท บริษัทถือว่าผู้ใช้เป็นเจ้าของเนื้อหาที่ตนสร้างขึ้นแต่เพียงผู้เดียว อย่างไรก็ตาม ผู้ใช้ยินยอมให้บริษัทมีสิทธิใช้ จัดเก็บ ทำซ้ำ เผยแพร่ หรือแสดงเนื้อหาดังกล่าวเพื่อวัตถุประสงค์ในการให้บริการ การประชาสัมพันธ์ หรือการปรับปรุงคุณภาพของแพลตฟอร์ม ผู้ใช้ต้องรับผิดชอบต่อความถูกต้องและความเหมาะสมของเนื้อหาที่ตนสร้าง และต้องไม่โพสต์เนื้อหาที่ละเมิดลิขสิทธิ์ ละเมิดสิทธิส่วนบุคคล หมิ่นประมาท หรือผิดกฎหมาย ผู้ใช้ยอมรับว่าบริษัทมีสิทธิลบหรือระงับเนื้อหาใด ๆ ที่เห็นว่าไม่เหมาะสมโดยไม่ต้องแจ้งให้ทราบล่วงหน้า และบริษัทจะไม่รับผิดชอบต่อความเสียหายที่เกิดจากการใช้เนื้อหาของผู้ใช้หรือการถูกลบของเนื้อหาดังกล่าว
6. พฤติกรรมต้องห้าม
ผู้ใช้ต้องใช้บริการของบริษัทด้วยความสุจริตและเคารพสิทธิของผู้อื่น ห้ามกระทำการใด ๆ ที่ผิดกฎหมายหรือฝ่าฝืนกฎระเบียบที่เกี่ยวข้อง รวมถึงแต่ไม่จำกัดเพียง การคุกคาม การกลั่นแกล้ง หรือการข่มขู่ผู้ใช้รายอื่น การเผยแพร่ข้อความ ลิงก์ รูปภาพ หรือเนื้อหาที่มีลักษณะหยาบคาย หมิ่นประมาท ละเมิดลิขสิทธิ์ ละเมิดความเป็นส่วนตัวของผู้อื่น หรือไม่เหมาะสมทางเพศ ผู้ใช้ต้องไม่ใช้บริการเพื่อการหลอกลวง การฉ้อโกง การโฆษณาโดยไม่ได้รับอนุญาต หรือการส่งสแปม นอกจากนี้ ผู้ใช้ต้องไม่พยายามเจาะระบบ ลบ ทำลาย หรือเข้าถึงข้อมูลของบริษัทหรือผู้ใช้อื่นโดยไม่ได้รับอนุญาต บริษัทมีสิทธิระงับหรือยกเลิกบัญชีของผู้ใช้ที่ฝ่าฝืนโดยไม่ต้องแจ้งล่วงหน้า และจะไม่รับผิดชอบต่อความเสียหายที่เกิดจากการกระทำของผู้ใช้ที่ละเมิดข้อกำหนด
7. ขอบเขตความรับผิด
บริษัทจัดให้บริการแอปพลิเคชันและฟีเจอร์ต่าง ๆ ด้วยความพยายามอย่างเต็มที่เพื่อให้บริการมีความถูกต้อง ครบถ้วน และราบรื่น แต่บริษัทไม่สามารถรับประกันได้ว่าบริการจะปราศจากข้อผิดพลาด ความล่าช้า หรือการขัดข้องในทุกกรณี ผู้ใช้ยอมรับว่า การสร้างความสัมพันธ์ การสื่อสารกับผู้ใช้รายอื่น หรือการรับคำแนะนำด้านดูดวงอาจไม่สามารถรับประกันผลลัพธ์ตามที่คาดหวังได้ บริษัทไม่รับผิดชอบต่อความเสียหายโดยตรง ทางอ้อม บังเอิญ ผลพวง หรือความเสียหายทางเศรษฐกิจที่เกิดขึ้นจากการใช้บริการ รวมถึงความเสียหายที่เกิดจากความประมาทของผู้ใช้รายอื่นหรือบุคคลภายนอก ผู้ใช้ยอมรับว่าการใช้บริการทั้งหมดเป็นไปด้วยความเสี่ยงของตนเอง และบริษัทมีขอบเขตความรับผิดจำกัดตามที่กฎหมายอนุญาต
8. สิทธิของผู้ให้บริการ
บริษัทมีสิทธิระงับหรือยกเลิกบัญชีของผู้ใช้ทันทีโดยไม่ต้องแจ้งให้ทราบล่วงหน้า หากพบว่าผู้ใช้กระทำการที่ฝ่าฝืนข้อกำหนดและเงื่อนไข รวมถึงพฤติกรรมต้องห้าม ผู้ใช้ให้ข้อมูลไม่ถูกต้องหรือไม่ครบถ้วน ผู้ใช้ใช้บัญชีโดยไม่ได้รับอนุญาตหรือมีการละเมิดความปลอดภัยของระบบ หรือหากบริษัทเห็นว่าการใช้บัญชีอาจเป็นอันตรายต่อบริษัท ผู้ใช้รายอื่น หรือบุคคลภายนอก การระงับหรือยกเลิกดังกล่าวอาจรวมถึงการปิดการเข้าถึงฟีเจอร์ทั้งหมด บริษัทจะไม่รับผิดชอบต่อความเสียหายที่เกิดจากการระงับหรือยกเลิกบัญชี และผู้ใช้ยอมรับว่าการตัดสินใจดังกล่าวเป็นสิทธิของบริษัทเพียงฝ่ายเดียว
9. การแก้ไขข้อกำหนด
บริษัทสงวนสิทธิในการแก้ไข ปรับปรุง หรือเพิ่มเติมข้อกำหนดและเงื่อนไขได้ตลอดเวลาโดยไม่ต้องแจ้งให้ผู้ใช้ทราบล่วงหน้า การแก้ไขจะมีผลทันทีเมื่อบริษัทเผยแพร่ข้อกำหนดที่ปรับปรุงแล้วบนแพลตฟอร์ม ผู้ใช้มีหน้าที่ตรวจสอบข้อกำหนดและเงื่อนไขอย่างสม่ำเสมอ การใช้บริการอย่างต่อเนื่องหลังจากที่มีการปรับปรุงถือว่าผู้ใช้ยอมรับและตกลงปฏิบัติตามข้อกำหนดฉบับปรับปรุงนั้น
10. กฎหมายที่ใช้บังคับและเขตอำนาจ
ข้อตกลงนี้อยู่ภายใต้กฎหมายของประเทศไทย (หรือเขตอำนาจที่บริษัทกำหนด) การพิพาทใด ๆ ที่เกี่ยวข้องกับบริการจะอยู่ภายใต้ศาลที่มีเขตอำนาจในประเทศไทย เว้นแต่กำหนดเป็นอย่างอื่น

12. ข้อกำหนดพิเศษสำหรับฟีเจอร์ดูดวง
A. คำอธิบายฟีเจอร์ — บริการดูดวงไพ่ยิปซีเป็นบริการความบันเทิง (Entertainment Purpose) ที่ออกแบบเพื่อให้แนวทางหรือสะท้อนมุมมองเกี่ยวกับสถานการณ์เท่านั้น ไม่ใช่บริการพยากรณ์อนาคตอย่างแม่นยำ และไม่ใช่คำแนะนำด้านกฎหมาย การแพทย์ สุขภาพจิต การเงิน หรือการจัดการชีวิต ผู้ใช้สามารถเลือกประเภทการดูดวงและระบุคำถามส่วนตัวเพื่อรับผลคำทำนายในรูปแบบข้อความหรือกราฟิก บริษัทไม่สามารถรับประกันความถูกต้องหรือผลลัพธ์ที่แน่นอน ผู้ใช้ยอมรับว่าการใช้ฟีเจอร์เป็นไปด้วยความสมัครใจและเป็นความเสี่ยงของตนเอง
B. ข้อจำกัดความรับผิด — บริการดูดวงจัดทำขึ้นเพื่อความบันเทิงและเป็นแนวทางในการสะท้อนความคิด ความรู้สึก และความสัมพันธ์ส่วนตัวเท่านั้น บริษัทและผู้อ่านไพ่ไม่มีหน้าที่รับรองผลลัพธ์หรือทำนายอนาคต และไม่สามารถรับประกันความถูกต้อง 100% การตัดสินใจหรือพฤติกรรมใด ๆ ที่เกิดจากคำทำนายเป็นความรับผิดชอบของผู้ใช้แต่เพียงผู้เดียว บริการดูดวงอาจไม่เหมาะสมสำหรับผู้ที่อยู่ในภาวะเครียดรุนแรง เจ็บป่วยทางจิตใจ หรือกำลังเผชิญปัญหาร้ายแรง ในกรณีดังกล่าวควรขอคำปรึกษาจากผู้เชี่ยวชาญที่เหมาะสม บริษัทไม่รับผิดชอบต่อผลลัพธ์ การสูญเสีย หรือความเสียหายที่เกิดจากการใช้คำทำนาย
C. ข้อมูลที่เก็บจากฟีเจอร์ดูดวง — บริษัทอาจเก็บข้อมูลที่ผู้ใช้ป้อนหรือสร้างขึ้น ซึ่งรวมถึงคำถามหรือหัวข้อที่ป้อน ข้อมูลส่วนบุคคล เช่น วันเกิด เพศ และข้อมูลโปรไฟล์ รวมถึงรูปภาพหรือเสียงที่อัปโหลด ข้อมูลการอ่านไพ่ เช่น ข้อความอัตโนมัติ รายงานผล หรือไฟล์เสียงและวิดีโอ อาจถูกเก็บเพื่อวิเคราะห์ ปรับปรุงคุณภาพ และจัดเก็บเป็นประวัติการใช้งาน ผู้ใช้มีสิทธิขอให้ลบประวัติดังกล่าวได้ การใช้และการเก็บข้อมูลทั้งหมดอยู่ภายใต้นโยบายความเป็นส่วนตัว
D. ความเป็นส่วนตัวและความเปราะบางของข้อมูล — ข้อมูลที่เก็บอาจมีลักษณะส่วนบุคคลและละเอียดอ่อน เช่น คำถามเกี่ยวกับความสัมพันธ์ ความรู้สึกส่วนตัว วันเกิด เพศ บริษัทมีมาตรการรักษาความปลอดภัยตามนโยบายความเป็นส่วนตัว แต่ผู้ใช้ต้องเข้าใจว่าการเปิดเผยข้อมูลในบริบทนี้ถือเป็นความสมัครใจ และบริษัทไม่สามารถรับประกันได้ว่าข้อมูลที่ป้อนจะไม่ถูกเปิดเผยต่อผู้ใช้รายอื่นในกรณีฟีเจอร์อนุญาตให้แชร์ ผู้ใช้ควรใช้ดุลยพินิจ และมีสิทธิจัดการ ลบ หรือควบคุมประวัติข้อมูลของตน
E. การชำระเงินสำหรับดูดวง — การเข้าถึงฟีเจอร์อาจต้องชำระค่าบริการในรูปแบบเครดิต การซื้อครั้งเดียว หรือระบบสมาชิกแบบ Subscription ในกรณีที่การอ่านดำเนินการโดยนักอ่านภายนอก การชำระเงินเป็นไปตามข้อตกลงระหว่างผู้ใช้กับนักอ่านแต่ละราย ผู้ใช้ยอมรับว่าบริษัทไม่รับประกันความพึงพอใจและไม่มีนโยบายคืนเงินหากบริการเริ่มดำเนินการแล้ว
F. การควบคุมคุณภาพและ Moderation — บริษัทมีสิทธิตรวจสอบคุณภาพการอ่าน ปรับปรุง และคัดกรองเนื้อหาที่อาจละเมิดจรรยาบรรณหรือสร้างความเสี่ยง รวมถึงจัดการกับรายงานการร้องเรียน เช่น การอ่านที่ก่อให้เกิดความกลัวเกินควร การให้คำแนะนำที่เป็นอันตราย เช่น การยุยงให้ทำร้ายตนเอง การคุกคาม หรือการใช้ถ้อยคำไม่เหมาะสม ผู้อ่านไพ่ต้องปฏิบัติตามจรรยาบรรณและแนวปฏิบัติที่บริษัทกำหนด
G. ข้อกำหนดด้านอายุ — เนื่องจากฟีเจอร์อาจมีเนื้อหาที่เกี่ยวข้องกับอารมณ์หรือมีผลต่อสภาพจิตใจ บริษัทแนะนำให้ผู้ใช้ที่มีอายุต่ำกว่า 18 ปีใช้บริการภายใต้การดูแลของผู้ปกครองอย่างเหมาะสม ผู้ใช้ที่มีอายุต่ำกว่าเกณฑ์อาจถูกจำกัดการเข้าถึงบางฟีเจอร์เพื่อความปลอดภัย
Terms of service
This English text is a courtesy translation. The Thai version above is the binding one; if they differ, the Thai version prevails.
1. Acceptance of terms
These Terms of Use ("Terms") govern the relationship between you ("user", "you") and the Company ("we", "us"), the provider of a social matchmaking platform with posts, stories, messaging, a tarot fortune-telling feature, and related services ("the service").
By accessing, installing, enabling or using our service — via website, mobile app or any channel — you confirm that you have read, understood and accepted these Terms in full, together with related policies such as the Privacy Policy and Community Guidelines. If you do not agree with all or part of these Terms, please stop using the service immediately.
2. Accounts & minimum age
You must be at least 18 years old to register and use the service. If you are found to be under this age, we may suspend or terminate your account immediately without prior notice. You must provide accurate, complete and current information — name, age, email, phone and anything else the system requests — and keep it up to date. You are responsible for your account, including keeping your password and access details confidential, and must not disclose or hand your account to others without permission. We are not liable for damage arising from unauthorised use of your account, and you must notify us immediately if you suspect your account has been accessed or compromised.
3. Service description
Our service includes but is not limited to: an online platform that helps users meet and build relationships, plus special features such as fortune-telling and love guidance. You can create a personal account, fill in information about yourself, and use features to find and communicate with others — posts, stories and various content. We strive to deliver the service smoothly, safely and privately, but cannot guarantee outcomes. You acknowledge that relationships formed, or guidance received through the fortune-telling feature, may vary from person to person. Our duty is only to provide the service as described on the platform.
4. Payment & refunds
To access paid features or in-app services, you must pay via the channels and methods we specify. All payments are final once we have confirmed receipt. You accept that some paid services may be non-refundable, and the Company reserves the right to consider refunds solely in cases of system error or fault on our part. All payments and use of the service are subject to the Company's terms, which you agree to follow strictly.
5. User-generated content
You may create content within the app — photos, text, profile data, chat messages. You remain the sole owner of content you create. However, you grant the Company the right to use, store, reproduce, publish or display that content for the purposes of providing the service, promotion, or improving platform quality. You are responsible for the accuracy and appropriateness of your content and must not post anything that infringes copyright or privacy, is defamatory, or unlawful. You accept that the Company may remove or suspend any content it deems inappropriate without prior notice, and is not liable for damage arising from your content or its removal.
6. Prohibited conduct
You must use the service in good faith and respect others' rights. You must not do anything unlawful or against relevant rules, including but not limited to: harassing, bullying or threatening other users; posting messages, links, images or content that is obscene, defamatory, infringes copyright or privacy, or is sexually inappropriate; using the service for deception, fraud, unauthorised advertising, or spam; or attempting to hack, delete, damage or access the data of the Company or other users without permission. The Company may suspend or terminate accounts that breach these terms without prior notice, and is not liable for damage arising from a user's violation.
7. Disclaimers & limitation of liability
We provide the app and its features with our best effort to be accurate, complete and smooth, but cannot guarantee the service will be free of errors, delays or interruptions in every case. You acknowledge that relationships formed, communication with other users, or fortune-telling guidance may not produce expected results. The Company is not liable for direct, indirect, incidental, consequential or economic damage arising from use of the service, including damage caused by other users' or third parties' negligence. You accept that all use of the service is at your own risk, and the Company's liability is limited to the extent permitted by law.
8. Termination / suspension
The Company may suspend or terminate your account immediately without prior notice if you breach these terms, engage in prohibited conduct, provide inaccurate or incomplete information, use your account without authorisation or breach system security, or if the Company considers the account may harm the Company, other users or third parties. Such action may include disabling access to all features. The Company is not liable for damage arising from suspension or termination, and you accept that this decision is the Company's sole right.
9. Modifications
The Company reserves the right to modify, update or add to these terms at any time without prior notice. Changes take effect once published on the platform. You are responsible for reviewing the terms regularly. Continued use after an update means you accept and agree to the updated terms.
10. Governing law & jurisdiction
These terms are governed by the laws of Thailand (or the jurisdiction the Company specifies). Any dispute relating to the service is subject to the courts of competent jurisdiction in Thailand, unless otherwise specified.

12. Fortune-telling feature (special terms)
A. Feature description — The tarot fortune-telling feature is for Entertainment Purposes, designed to offer guidance or reflection on a situation only. It is not accurate future prediction, and not legal, medical, mental-health, financial or life advice. You can choose a reading type and ask a personal question to receive a result as text or graphics. The Company cannot guarantee accuracy or a definite outcome. You use it voluntarily and at your own risk.
B. Disclaimer — The reading is for entertainment and self-reflection only. The Company and readers do not guarantee results or predict the future, and cannot guarantee 100% accuracy. Any decision or behaviour based on a reading is solely your responsibility. Fortune-telling may not be suitable for those under severe stress, mental illness, or facing serious problems — in such cases, seek advice from an appropriate professional. The Company is not liable for any loss or damage from using the readings.
C. Data collected — We may collect what you enter or create in the feature: your question or topic, personal data such as birth date, gender and profile data, and images or audio you upload. Reading data such as auto-generated text, result reports or audio/video may be stored to analyse, improve the feature and keep as your usage history. You may ask us to delete this history. All use and storage is subject to our Privacy Policy.
D. Privacy & sensitive contexts — Data collected here may be personal and sensitive (relationship questions, feelings, birth date, gender). We secure it per our Privacy Policy, but you must understand that disclosure in this context is voluntary, and we cannot guarantee data you enter won't be seen by other users if the feature allows sharing. Use your judgement, and you may manage, delete or control your data history.
E. Payment — Access may require payment as credits, one-time purchase or subscription. Where a reading is done by an external reader, payment is per your agreement with that reader. You accept there is no satisfaction guarantee and no refund once a reading has started.
F. Quality control & moderation — The Company may review reading quality, improve and filter content that breaches ethics or creates risk to users, and handle complaints (e.g. readings causing excessive fear, dangerous advice such as inciting self-harm, harassment, or inappropriate language). Readers must follow the ethics and guidelines the Company sets.
G. Age restriction — Because the feature involves emotional content that may affect mental state, the Company recommends users under 18 use it under appropriate parental supervision; under-age users may have certain features restricted for safety.
